PRIVACY AND SECURITY POLICY - SOFTWARE ACCESS AND SUPPORT SERVICES AGREEMENT
This is the Privacy and Security Policy referred to in clause 13.2 of the Access Agreement. Unless otherwise defined, capitalized terms in this Privacy and Security Policy have the meanings set out in the Access Agreement.
This Privacy and Security Policy applies to the use of the Services and Support Services (together the “Services”) and the Customer Data collected by Medtech for the provision of those Services.
Collection of personal information
Medtech may require Customers and Permitted Users to provide Customer Data containing personal information for the purpose of providing the Services.
To comply with the Privacy Act 1993, Permitted Users who provide Medtech with personal information about any other person must ensure that they have appropriate permission to provide us with that information. Each Permitted User must be able to provide to Medtech (and be authorised by the relevant person to provide) permission for all personal information that they provide to be used for the purpose of the Services. The individual to which any personal information relates has the right to access and make corrections to their personal information under by contacting Medtech at any time. Permitted Users must ensure that the individual is made aware of these rights.
Storage of information
All Customer Data containing personal information will be hosted in a secure environment by a commercially reputable hosting vendor using best-practice industry standards and security techniques.
How we may use your personal information
Personal information contained in Customer Data collected by Medtech will be used for the purpose of providing the Services and for no other purpose. Medtech may use other companies as part of providing the Services on its behalf, such as for the provision of network services. If Medtech provides personal information to such companies, Medtech will only disclose the personal information needed to deliver the relevant Services. Such companies are required to maintain the confidentiality of the personal information and are prohibited from using that information for any other purpose.
Medtech may disclose personal information if required to do so by law or in good faith believe that such action is necessary to: comply with the law or comply with legal proceedings served on Medtech; protect and defend the rights or property of Medtech and its family of websites; or act in urgent circumstances to protect the personal safety of users of Medtech products or members of the public. Information collected will be stored and processed in New Zealand.
E-mail controls
To keep you informed of the latest improvements, Medtech may send you newsletters where you have consented to receiving them. If you have consented to receive newsletters but no longer wish to receive them, you can unsubscribe at any time through the "unsubscribe" link in the newsletters.
Use of cookies
We only use temporary cookies on this website which are deleted upon you signing out. The cookies contain no personal information.
Changes to this privacy and security policy
In accordance with clause 13 of the Access Agreement, Medtech may occasionally update this Privacy and Security Policy. When we do, we will also revise the "last updated" date at the top of the Privacy and Security Policy. We encourage you to review this Privacy and Security Policy periodically to stay informed about how we are helping to protect the personal information we collect.
Security Policy
All Customer Data is securely stored at Medtech’s data centre. When any Customer Data is provided to Medtech it is sent over the Internet using Secure Sockets Layer (SSL) protocol. This method encrypts the information to help prevent others from reading it while it's in transit.
Medtech has incorporated all reasonable measures to protect Customer Data, however, we are reliant upon the Customer to do the same. Medtech’s liability for any loss or damage to Customer Data caused by Medtech is limited in accordance with section 13.2 of the Access Agreement. Medtech is not liable for any loss or damage to Customer Data caused by the Customer, its Permitted Users, or third parties, including where caused by accidental or unauthorised access to Customer Data or to this website.
Accidental or unauthorised access could be obtained by Permitted Users remaining logged on and leaving their computer unattended, 'over-the-shoulder' access or from unsecure print-outs of access details.
Unauthorised access could involve someone known to a Permitted User guessing their password or a stranger/hacker circumventing our security measures. Access details should never be given to any unauthorised person.
